These Terms of Use ("Terms") govern your access to and use of Fresto (the "Platform"), including its website and applications, through which users can discover restaurants, order food for delivery, pickup or consumption at a restaurant, and request table reservations.
The Platform is operated by EURL Techpos ("we", "us" or "our").
By accessing or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.
These Terms do not limit any mandatory rights you may have under applicable consumer protection laws.

Where required by applicable law, additional company identification and contact information will be provided through the Platform or relevant legal documentation.
2. Our Role as a Platform
Fresto provides technology that connects customers with independent restaurants.
Fresto is an intermediary platform, not a restaurant or food delivery company.
Unless expressly stated otherwise:
- Restaurants operate as independent businesses.
- Restaurants are responsible for their menus, prices, ingredients, allergen information, food preparation, food safety, and fulfilment of accepted orders.
- When you place an order, the contract for the food and its fulfilment is between you and the restaurant, subject to the order acceptance process described in these Terms.
- When you request a table reservation, the reservation arrangement is between you and the restaurant once the restaurant accepts it.
- Fresto provides the technology through which orders, reservations, and related information are transmitted and managed.
Fresto does not prepare food or deliver orders.
Under our current payment model, customers pay restaurants directly. Fresto does not collect payment for food orders through the Platform.
Nothing in these Terms excludes any responsibility or liability that applicable law imposes directly on Fresto.
3. Eligibility and Your Account
You may use the Platform as a guest or create an account where account registration is available.
You must have the legal capacity required to enter into a binding agreement under the laws applicable to you. If you are a minor, you may use the Platform only as permitted by applicable law and, where required, with the involvement or consent of a parent or legal guardian.
Certain products, including alcoholic beverages where offered, may be subject to minimum-age requirements. You must satisfy the applicable age requirements before ordering such products. Restaurants may request proof of age before completing an order.
You agree to:
- Provide accurate, complete, and up-to-date information.
- Keep your login credentials confidential.
- Take reasonable steps to prevent unauthorised access to your account.
- Notify us promptly if you suspect that your account has been compromised.
- Use the Platform only for lawful purposes.
You must not share your account in a way that compromises its security or permits unauthorised use.
You may update your information through your profile where that functionality is available. To request account closure, contact eurltechpos@gmail.com.
Closing your account does not cancel obligations arising from previous orders, reservations, or separate agreements. We may retain information where required or permitted by applicable law, as explained in our Privacy Policy.
4. Orders
4.1 Placing an Order
You may select products offered by a restaurant and submit an order through the Platform.
Before confirming your order, review the selected items, quantities, prices, applicable taxes, delivery charges, discounts, and total amount displayed.
The total shown before confirmation is the amount payable for the order, subject to any changes you expressly agree to and any adjustments required by applicable law.
By confirming an order, you submit a request to purchase the selected products from the restaurant.
4.2 Restaurant Acceptance
Submitting an order does not automatically mean that the restaurant has accepted it.
The restaurant may accept or reject an order. Where applicable, the contract between you and the restaurant is formed when the restaurant accepts your order.
A restaurant may reject an order for legitimate reasons, including:
- The restaurant is closed or temporarily unavailable.
- One or more items are unavailable.
- Your delivery address is outside its delivery area.
- The restaurant cannot fulfil the order.
- A technical or operational problem prevents fulfilment.
If an order is rejected, you will not be required to pay for products that are not supplied, subject to applicable law and any payment already made.
If you have already paid the restaurant, the restaurant is responsible for any refund it owes, without prejudice to any obligations imposed on Fresto by law.
You may track your order through the available order-tracking functionality.
4.3 Prices, Taxes and Payment
Restaurants determine their own menu prices, delivery charges, and other applicable commercial conditions.
Prices are displayed in the currency indicated on the Platform. Applicable taxes and mandatory charges will be disclosed as required by law.
Customers pay restaurants directly. Depending on the restaurant, available payment methods may include cash or card payment on delivery or at pickup.
For orders placed at a restaurant table, payment is made directly to the restaurant as instructed by its staff.
Fresto does not currently collect payment for food orders through the Platform. Any future change to the payment model will be communicated through the relevant Platform information and terms.
Restaurants are responsible for providing accurate pricing and payment information.
4.4 Delivery and Pickup
Delivery and pickup options depend on the restaurant, its operating arrangements, and the location of the order.
Delivery and pickup times displayed on the Platform are estimates unless expressly stated otherwise. Actual times may vary due to demand, preparation time, traffic, weather, or other circumstances.
Restaurants are responsible for fulfilling accepted orders in accordance with applicable law.
You are responsible for providing accurate delivery information and ensuring that the delivery location is accessible.
4.5 Changes and Cancellations
If you need to change or cancel an order, contact the restaurant as soon as possible through the available contact or order-support options.
Whether a change or cancellation can be accepted depends on the order's status, including whether preparation has started, and on applicable law.
Once food preparation has begun, the restaurant may be unable to accept a requested change or cancellation, subject to your mandatory legal rights.
If an order is rejected, cancelled, or cannot be fulfilled, any payment or refund due will be handled in accordance with the applicable payment arrangements and legal requirements.
Nothing in this section limits your statutory rights or remedies for incorrect, defective, or undelivered orders.
4.6 Right of Withdrawal
Where EU consumer law applies, consumers generally have a 14-day right of withdrawal for qualifying distance contracts, subject to statutory exceptions.
Exceptions may include contracts for goods liable to deteriorate or expire rapidly and certain catering services provided on a specific date or during a specific period, as provided for in Article 16 of Directive 2011/83/EU and applicable national law.
Whether an exception applies depends on the nature of the product or service and the circumstances of the transaction.
Nothing in these Terms removes a right of withdrawal where it is legally available or limits other mandatory consumer rights.
4.7 Problems with an Order
If an order is missing, incorrect, damaged, significantly delayed, or not delivered, contact the restaurant promptly.
You may also contact Fresto through our Customer Service page.
We will assist with platform-related issues and, where appropriate, help direct your complaint to the restaurant.
Restaurants remain responsible for resolving issues concerning the food and fulfilment of their orders, subject to any legal obligations imposed on Fresto.
Your statutory rights remain unaffected.
5. Ordering at a Table
Where a restaurant supports table ordering, you may scan a QR code or use another ordering method provided at the restaurant.
Orders submitted through a table-specific QR code are transmitted to the restaurant and associated with the relevant table where supported.
The restaurant is responsible for preparing and serving the order.
We may apply reasonable technical limits to the number or frequency of orders submitted through a QR code, device, account, or other access method to prevent abuse, fraudulent activity, or disruption.
You must not misuse table-ordering functionality or submit orders without a genuine intention to purchase.
Payment is made directly to the restaurant in accordance with its payment arrangements.
6. Table Reservations
The Platform may allow you to submit reservation requests to participating restaurants.
A reservation request is not confirmed until the restaurant accepts it. The restaurant may accept or reject the request or propose an alternative date, time, or arrangement.
You may accept or decline any proposed alternative.
Once a reservation is confirmed, you should arrive at the agreed time and comply with reasonable reservation conditions communicated by the restaurant.
If your plans change, cancel your reservation through the Platform where possible or contact the restaurant directly.
Restaurants determine their policies regarding late arrivals, no-shows, seating duration, and reservation changes, subject to applicable law and conditions disclosed before booking.
If a reservation requires a deposit, prepayment, or cancellation fee, the applicable amount and conditions must be disclosed before you agree to them.
If a restaurant cancels a confirmed reservation, any deposit or payment refund due will be handled in accordance with the disclosed reservation terms and applicable law.
Fresto does not guarantee that a particular table, seating arrangement, or restaurant service will be available.
7. Allergens and Dietary Requirements
Restaurants are responsible for providing accurate information about ingredients, allergens, and other relevant food characteristics.
Where EU food-information rules apply, restaurants must comply with their obligations under Regulation (EU) No 1169/2011, including applicable requirements for non-prepacked food and distance selling.
Information displayed on the Platform is supplied by the relevant restaurant. Fresto does not independently verify every ingredient or allergen statement.
If you have a food allergy, intolerance, or other dietary requirement, contact the restaurant directly before placing your order.
Cross-contamination may occur during food preparation or handling despite reasonable precautions.
If you have a severe allergy, do not rely solely on information displayed on the Platform. Obtain confirmation directly from the restaurant before ordering.
Nothing in this section excludes any legal responsibility that applies to Fresto or a restaurant.
8. Reviews, User Content and Illegal Content
8.1 Reviews
Where review functionality is available, eligible customers may submit reviews of completed orders.
Reviews may include a rating, written comment, and the name associated with the order, subject to the Platform's functionality and applicable privacy rules.
Restaurants may be permitted to respond publicly to reviews.
Reviews must reflect genuine experiences and must not be fraudulent, misleading, or unlawful.
We do not knowingly accept fake reviews or offer payment in exchange for positive reviews. We do not remove or alter reviews solely because they are negative, and we do not accept payment in exchange for removing legitimate negative reviews.
We may use reasonable measures to verify review eligibility and detect suspicious activity.
Where required by applicable law, we will explain how reviews are collected, verified, and presented.
8.2 Prohibited Content
You must not submit content that:
- Is illegal or infringes another person's rights.
- Contains threats, harassment, hate speech, or unlawful discrimination.
- Contains spam, fraudulent claims, or deliberately misleading information.
- Discloses another person's personal information without a lawful basis.
- Is a fake review or is intended to manipulate ratings.
- Contains malicious code or attempts to compromise the Platform.
- Otherwise violates these Terms or applicable law.
We may remove, restrict, or disable access to content that violates these Terms or applicable law.
Where required by law, we will explain the action taken and provide information about available review or appeal procedures.
8.3 Reporting Potentially Illegal Content
If you believe that content available through the Platform is illegal, you may report it by emailing eurltechpos@gmail.com.
Please include, where possible:
- The exact URL or location of the content.
- A description of the content.
- An explanation of why you believe it is illegal.
- Your name and email address, where required for processing the report.
Please provide sufficient information to allow us to identify and assess the content.
We will review reports in accordance with applicable law and take appropriate action where necessary.
Where required by law, we will acknowledge receipt, communicate our decision and its reasons, and provide information about available complaint or appeal mechanisms.
8.4 Content Moderation and Appeals
Where we remove content, restrict access to content, or suspend an account, we will provide the affected user with an explanation and information about available review procedures where required by applicable law.
You may request a review of a moderation decision by emailing eurltechpos@gmail.com.
Where an internal review is legally required, it will be handled by a person who was not responsible for the original decision, where required by law and reasonably practicable.
Nothing in this section limits your right to seek remedies through a competent court or an applicable out-of-court dispute-resolution mechanism.
9. Acceptable Use
You must not:
- Place false, fraudulent, or prank orders or reservations.
- Use the Platform for unlawful purposes.
- Harass, threaten, or abuse restaurant staff, delivery personnel, other users, or our staff.
- Impersonate another person or misrepresent your identity.
- Submit false information or manipulate reviews, ratings, or order activity.
- Attempt to gain unauthorised access to the Platform, its systems, or another user's account.
- Probe, scan, overload, disrupt, or interfere with the security or operation of the Platform.
- Introduce viruses, malicious code, or other harmful technology.
- Copy, extract, or collect Platform content through automated means, including scraping, without our prior permission, except where such restriction is prohibited by applicable law.
- Use the Platform in a way that infringes intellectual property, privacy, or other legal rights.
We may take proportionate measures to prevent or address violations, including rejecting orders, restricting functionality, suspending accounts, or reporting unlawful conduct to the relevant authorities.
Where required by law, we will provide notice and information about available review procedures.
10. Terms for Restaurants
This section applies to businesses that register or maintain a restaurant listing on Fresto ("Restaurants").
Additional terms may apply where a restaurant obtains a software licence or uses other services provided by EURL Techpos.
10.1 Registration and Approval
Restaurants must provide accurate and complete business information and any documents reasonably required for verification.
We may review applications before publishing a restaurant listing and may refuse or delay publication where information is incomplete, inaccurate, or raises legitimate legal, safety, or operational concerns.
A listing does not constitute an endorsement or guarantee by Fresto of the restaurant's quality, legal compliance, or financial standing.
10.2 Restaurant Responsibilities
Each restaurant represents that it operates in a professional capacity and is authorised to offer the products and services listed on the Platform.
Restaurants are responsible for:
- The accuracy of their business information.
- Their menus, prices, taxes, and additional charges.
- Opening hours and product availability.
- Ingredient, allergen, and dietary information.
- Compliance with applicable food-safety and hygiene requirements.
- Obtaining and maintaining required licences and permits.
- The lawful preparation, handling, packaging, and delivery of food.
- Accepting, rejecting, and fulfilling orders.
- Providing the products and services promised to customers.
- Complying with applicable consumer protection, tax, employment, and data-protection laws.
Restaurants must promptly update information that becomes inaccurate or outdated.
10.3 Software Activation and Restaurant Licensing
Restaurants may obtain Fresto software and submit an online activation request through the available activation process.
Submitting an activation request does not automatically grant a licence or guarantee approval.
EURL Techpos will review the request and may contact the restaurant to discuss its requirements, licensing options, applicable fees, and other commercial conditions.
The licence will be granted once the request has been approved and the applicable licensing terms have been agreed between EURL Techpos and the restaurant.
The licence fee, scope of use, duration, renewal conditions, support arrangements, and any applicable termination or refund conditions will be communicated during the licensing process or set out in a separate licence agreement or other applicable written terms.
Restaurants must provide accurate information during activation and must not use licensed features or services beyond the scope of the licence granted to them.
Submitting an activation request does not create an automatic subscription or recurring payment obligation. Any payment obligations arise from the licence terms or other commercial agreement expressly accepted by the restaurant.
10.4 Ranking and Visibility
Fresto provides restaurant discovery and sorting functionality to help customers find restaurants.
By default, the Platform prioritises restaurants designated as featured by Fresto, followed by average customer rating.
Depending on the available functionality, customers may also sort restaurants by rating, popularity based on order volume, estimated delivery time, newest listings, name, and distance.
Featured status is currently assigned by Fresto and is not a paid placement service. Featured status does not guarantee a particular position in every search or a minimum number of orders.
Fresto may introduce additional restaurant promotion or paid visibility options in the future. If such options are introduced, we will update the relevant terms and disclose commercial placements as required by applicable law.
We may modify ranking criteria and sorting options as the Platform evolves. Where required by applicable law, we will make available information about the main parameters determining restaurant rankings and the relative importance of those parameters.
10.5 Restaurant Content
Restaurants retain ownership of their names, logos, photographs, menus, and other content they provide, subject to third-party rights.
By submitting content to Fresto, a restaurant grants us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, distribute, and adapt that content to the extent reasonably necessary to operate, promote, and provide the Platform and its services.
This licence includes displaying restaurant content on the Platform and in related promotional materials.
Restaurants confirm that they have the rights and permissions necessary to grant this licence.
The licence continues for as long as reasonably necessary to fulfil its purposes, including the removal of cached copies, backups, or materials already distributed, subject to applicable law.
10.6 Customer Data
Restaurants may receive customer information necessary to process and fulfil orders or reservations.
Restaurants must use this information only for purposes permitted by law and the applicable agreement.
Restaurants must not use customer information for unrelated marketing, sell it, disclose it to unauthorised parties, or retain it longer than necessary, unless they have a lawful basis to do so.
Fresto and each restaurant must comply with their respective obligations under applicable data-protection law.
The parties' respective roles, responsibilities, and any applicable data-processing arrangements are described in the Privacy Policy and any separate agreement.
Restaurants must implement appropriate security measures and promptly notify Fresto of any personal-data incident affecting information obtained through the Platform where notification is necessary for compliance or the operation of the service.
10.7 Suspension and Termination
A restaurant's right to use Fresto software is governed by the applicable licence agreement or licensing terms agreed with EURL Techpos.
We may suspend or terminate access to the Platform or licensed services where reasonably necessary because of:
- A serious or repeated breach of these Terms or the applicable licence agreement.
- Unlawful conduct or fraudulent activity.
- A significant risk to customers, restaurants, or the Platform.
- Unauthorised use of the software or access credentials.
- Failure to comply with applicable licensing conditions.
- A legal requirement or an urgent security concern.
Where reasonably practicable, we will notify the restaurant of the reasons for suspension or termination and provide an opportunity to address the issue.
Where a licence or service is terminated by EURL Techpos, we will provide at least 30 days' notice where required by the applicable agreement or law, unless immediate action is reasonably necessary because of serious misconduct, an urgent risk, or a legal obligation.
Any licence fees, refunds, outstanding obligations, and rights following termination will be governed by the applicable licence agreement and mandatory legal requirements.
Where required by applicable law, we will provide reasons for our decision and information about available complaint or review procedures.
10.8 Restaurant Complaints
Restaurants may submit complaints concerning Fresto's services, account decisions, licensing arrangements, or application of these Terms by emailing eurltechpos@gmail.com.
We will review complaints in good faith and provide a response with reasons within a reasonable period, subject to applicable legal requirements.
Where applicable law provides additional complaint-handling or dispute-resolution rights, those rights remain unaffected.
11. Intellectual Property
The Platform, including its software, design, branding, graphics, and other materials, is owned by EURL Techpos or its licensors, except for content belonging to restaurants or other third parties.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to access and use the Platform for its intended purposes.
You must not copy, modify, distribute, reverse engineer, or commercially exploit the Platform except where we have authorised the activity or applicable law permits it.
Restaurant names, logos, menus, photographs, and other third-party materials remain the property of their respective owners.
Software licences granted to restaurants are governed by the applicable licence agreement or licensing terms.
Nothing in these Terms transfers ownership of intellectual property to you.
12. Platform Availability and Changes
We aim to keep the Platform available and functioning properly, but we do not guarantee uninterrupted, error-free, or continuous availability.
The Platform may occasionally be unavailable because of maintenance, technical problems, security incidents, third-party service failures, or circumstances beyond our reasonable control.
We may modify, update, suspend, or discontinue features where reasonably necessary for operational, technical, security, legal, or commercial reasons.
Where a change materially affects users, we will provide notice where required by applicable law.
Nothing in this section excludes any mandatory rights relating to digital services or digital content.
13. Liability
Nothing in these Terms excludes or limits any liability, responsibility, or remedy that cannot lawfully be excluded or limited.
In particular, these Terms do not exclude liability for fraud, wilful misconduct, or any other matter for which exclusion or limitation is prohibited by applicable law.
Fresto provides a technology platform connecting customers with independent restaurants. Restaurants are responsible for their food, menus, pricing, allergen information, preparation, and fulfilment of accepted orders.
However, this allocation of responsibility does not exclude any obligation or liability that applicable law imposes directly on Fresto, including obligations relating to the Platform itself, our own acts or omissions, or mandatory consumer protection requirements.
To the extent permitted by law, we are not responsible for losses arising solely from a restaurant's independent acts or omissions where we have no legal responsibility for those acts or omissions.
Nothing in this section limits your statutory rights or any remedies available under applicable law.
14. Personal Data and Cookies
We process personal data in accordance with our Privacy Policy.
Information about cookies and similar technologies, including how they are used and how you can manage your preferences, is available on our Cookies & GDPR page.
Where consent is required for cookies or similar technologies, we will obtain it in accordance with applicable law.
Your rights regarding personal data are described in the Privacy Policy.
15. Changes to These Terms
We may update these Terms to reflect changes in the law, our services, security requirements, or business operations.
The date at the beginning of these Terms indicates when they were last updated.
For material changes affecting consumers, we will provide advance notice where required by law. Changes will apply from the effective date stated in the notice and will not retrospectively alter completed transactions, except where permitted or required by law.
If you do not agree with a change, you may stop using the Platform and close your account.
Changes affecting restaurant licences or other separately agreed commercial terms will be handled in accordance with the applicable licence agreement and mandatory legal requirements.
Where notice is required by applicable law, we will provide that notice within the applicable period.
16. Complaints and Dispute Resolution
If you have a complaint about the Platform, please contact us through our Customer Service page or by emailing eurltechpos@gmail.com.
We will review your complaint and endeavour to respond within a reasonable period.
Where applicable law provides access to an alternative dispute-resolution procedure or another out-of-court complaint mechanism, you may use that procedure in accordance with its rules.
Nothing in these Terms prevents you from bringing proceedings before a competent court or exercising any mandatory rights available to you.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of Algeria, without prejudice to any mandatory consumer protection provisions that apply under the law of another country.
Fresto currently operates in Algeria. If Fresto expands its services to Spain or other countries, the Platform and its services will be subject to the applicable legal requirements in those markets.
If you are a consumer habitually resident in an EU Member State and Fresto directs its activities to that country, you retain the protection of the mandatory consumer protection provisions that apply to you under the relevant law.
Nothing in these Terms deprives a consumer of the right to bring proceedings before a court that has jurisdiction under applicable mandatory law.
For disputes with restaurants acting in a professional capacity, the competent courts shall be determined in accordance with Algerian law and any applicable contractual or mandatory jurisdiction rules.
Nothing in this section overrides mandatory rules governing jurisdiction or the enforceability of consumer or business contracts.
18. General Provisions
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Our failure to enforce a provision does not constitute a waiver of our right to enforce it later.
These Terms, together with any applicable additional terms expressly incorporated into them, govern your use of the Platform.
Where a separate licence agreement applies to restaurant software, that agreement governs the relevant licensing matters. In the event of a conflict, the documents will be interpreted together to the extent possible, subject to mandatory legal requirements.
Where a translated version of these Terms is provided, the applicable version and any priority between language versions will be determined in accordance with applicable law and any language-priority notice presented to you.
